O&M Terms and Conditions

This Membership Agreement ('Agreement') governs participation in The Solar Lady Monitoring & Maintenance Membership Program. By submitting the initial membership payment, the Member acknowledges that they have read, understood, and agreed to be bound by this Agreement. 

1. Definitions Member: The individual or entity enrolling in the Membership Program. Covered Services: The services specifically identified within the Member's selected membership tier. Membership Term: The period during which the Member remains current on all required payments. 

2. Membership Tiers 

• Tier 1 (Watchdog)– Monitoring Only: System monitoring, production alerts, and notification of identified issues.

 • Tier 2 (Plus) – Monitoring Plus: Monitoring, annual site inspection, panel cleaning, troubleshooting assistance, warranty claim coordination, and labor/service call discounts. 

• Tier 3 – (Deluxe) Premium Protection: All Tier 2 benefits plus annual tune-ups and up to $500 of eligible labor coverage per membership year. 

3. Waiting Periods Monitoring benefits become effective immediately upon enrollment. Discounted labor and service call benefits become available after ninety (90) consecutive days of active membership. The Tier 3 labor coverage benefit becomes available only after twelve (12) consecutive monthly payments have been made and the membership remains in good standing

4. Continuous Membership Requirement Membership payments must remain current and uninterrupted to maintain eligibility for benefits. If a membership lapses or is cancelled, waiting periods may restart upon re-enrollment. 

5. Labor Coverage Limitations Tier 3 labor coverage is limited to a maximum benefit of $500 per membership year. Labor coverage applies only to eligible services performed by approved service providers. Unused benefits do not accumulate, roll over, or convert to cash value. 

6. Exclusions This Membership Program is not an insurance policy or extended warranty. Membership does not extend manufacturer warranties or guarantee repair outcomes. Members remain responsible for equipment costs, replacement parts, engineering services, permitfees, inspection fees, utility charges, and any services not expressly identified as covered benefits. 

7. Independent Contractors Certain services may be performed by independent contractors who maintain their own licensing and insurance coverage. The Solar Lady does not guarantee the performance of third-party providers. 

8. Automatic Renewal and Payments Membership automatically renews on the selected billing cycle unless cancelled by the Member. By enrolling, the Member authorizes recurring payments using the payment method provided. 

9. Cancellation Members may cancel at any time. Cancellation terminates future eligibility for membership benefits. Benefits subject to waiting periods shall not survive cancellation. 

10. Limitation of Liability To the fullest extent permitted by law, The Solar Lady and its affiliates shall not be liable for indirect, incidental, special, or consequential damages arising from participation in the Membership Program. 

11. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey. 

12. Acceptance of Terms By making the initial membership payment, the Member acknowledges acceptance of these terms without the need for a separate signature.
